The lawsuit lame duck president Donald Trump has filed in the US Supreme Court against the Commonwealth of Pennsylvania was finally put on the docket for the Supreme Court this afternoon, but the filing requires the Pennsylvania Secretary of State to respond to the filing by noon on Wednesday, December 23rd, two hours before the motion was made public.
Filed by John Eastman, the lawyer who claimed in a Newsweek op/ed that Vice President-elect Kamala Harris was not eligible for office because her parents were immigrants–even though she was born in California–the motion also included a writ of certiorari, which was filed December 21st.
A response by the defendant, Pennsylvania Secretary of State Kathy Boockvar, isn’t due until January 22, 2021, two days after the scheduled inauguration of President-elect Joe Biden.
The lack of action from the SCOTUS justices on motions to expedite the lawsuit demonstrate the lack of likelihood that the case will go anywhere.
