A lawyer representing Donald Trump in a lawsuit seeking an injunction against Georgia Governor Brian Kemp and Secretary of State Brad Raffensperger filed a motion to withdraw the motion Thursday, claiming that a settlement has been reached in the case.

The problem:  the case was tossed from Court by a judge earlier this week and the defendants in the case say no settlement has even been discussed, let alone agreed to.

Trump’s lawyer Kurt Hilbert filed the motion for voluntary dismissal, asking the Court to close the case “without prejudice due to an out of court settlement agreement” [stress in original document].

The Georgia officials’ lawyers, however, filed a separate notification with the Court, saying they agree with the voluntary dismissal, but that no settlement had been reached.

“Defendants do not object to the voluntary dismissal.  Defendants do object to the false grounds articulated in the motion,” the filing states.  “Plaintiff Donald J. Trump voluntarily dismissed this litigation contending the dismissal is a result of settlement between the Parties.  It is not.  There is no such ‘settlement.’  The demonstrably false characterizations by Plaintiff’s counsel are addressed herein in this response.”

Kemp’s and Raffensperger’s lawyers go on to cite the recorded phone call Trump, his lawyers and White House chief of staff Mark Meadows had with Raffensperger, noting that the call was out of order because it was not arranged through Raffensperger’s counsel.
