A teacher who was falsely accused of leaving a door to Robb Elementary School open and a parent whose 10-year-old daughter was killed in the May 24th mass murder in Uvalde, Texas have each stated their intention to sue Daniel Defense, the manufacturer of the assault rifle used by the 18-year-old shooter to kill 19 students and two teachers, the San Antonio Express-News reports.

Alfred Garza III, whose 10-year-old daughter Amerie Jo Garza was one of the students killed, has retained the services of the same legal team who won a $73 million settlement against Remington Arms, the now-bankrupt manufacturer of the assault weapons used to murder 20 first graders and six teachers at Sandy Hook Elementary in 2012.

In a separate suit, lawyers for Emilia Marin–the teacher falsely accused by Senator Ted Cruz (R-Quintana Roo), police officials, Texas politicians and conservative media of leaving a back door to the school wide open to allow the shooter to enter the school, even though security footage clearly shows her closing the door–have filed a motion with the court to get permission to gather information and evidence for a potential suit against Daniel Defense. 

“At a minimum, she has suffered severe and lasting psychological trauma. She is currently being treated for her condition associated with the violence inflicted upon her and others,” one of her lawyers said Friday. “She is definitely not the only survivor who will suffer these effects for the rest of their lives. Countless children, all who were at the school that day, are no doubt experiencing the same horrific damages.”

Daniel Defense has been accused of marketing their weapons inappropriately to children and others who should not have possession of a weapon of war.  Some of their advertising features children handling their weapons, including a photo of a toddler with an assault rifle in his lap and a loaded magazine at his side.
