Brooklyn Senior federal Judge Raymond Dearie’s time serving as special master in the Trump Mar-a-Lago documents case is probably not going to last much longer. This is not because he’ll have completed the review anytime soon but that, per Politico’s Josh Gerstein, two of the three judges drawn Tuesday on the 11th Circuit Court of Appeals to decide whether he’ll continue the review are Andrew Brasher and Britt Grant, two of the same (Trump-appointed) jurists who in September squashed the most crucial part of shitty lower Circuit Judge Aileen Cannon’s ruling blocking Justice Department prosecutors from criminally investigating her client Donald’s theft of classified documents from the White House when he left office in disgrace in January 2021.
Back in September, Brasher and Grant signed onto an opinion finding they “had reason enough to conclude that the district court abused its discretion in exercising equitable jurisdiction” in trying to slow down the investigation by appointing Dearie. So even though he appointed these guys, Trump got dealt a really, really, really bad hand with this appellate draw and their ruling, whenever it comes, is almost certainly going to further shred Cannon’s ruling.
