After a judge ruled that Newsmax had indeed published false information about the election software company, Smartmatic will take its lawsuit against the conservative misinformation network to a jury in a case scheduled to start at the end of the month, NBC News reports.
Delaware state judge Eric Davis said Newsmax broadcast and posted repeated false reports about Smartmatic and its involvement in the 2020 election. Newsmax went all-in on election conspiracy theories so effectively it drew audience away from stalwart Fox “News,” which paid Dominion Voting Systems $787.5 million in its own defamation case.
