“‘The Reciprocal Trade Agreements Act (RTAA) of 1934 was a landmark law that gave the president the authority to negotiate bilateral, reciprocal trade agreements with other countries, allowing tariff reductions in exchange for similar concessions from trading partners.’ Appeal to SCOTUS, win” – Top comment on the Daily Wire article “Appeals Court Strikes Down Sweeping Trump Tariffs, Setting Up Battle At Supreme Court,” posted Friday night shortly after the big news that National Zero missed.
From the article itself: “The US Court of Appeals for the Federal Circuit ruled 7-4 that Trump overstepped his authority under the International Emergency Economic Powers Act (IEEPA).” As in not the RTAA, a trade statute with a completely different process with a much more limited scope for thoroughly negotiated bilateral trade agreements, not tariffs, that STILL has to involve Congress in the decision. Which is why never invoked it and thus the RTAA has absolutely fucking nothing, nothing at all to do with this ruling. This asshole Daily Wire commenter had five months to have the most basic understanding of the laws at work here. Or he and the 33 other dipshits who upvoted him could’ve just read the article above the post and maybe they would’ve gotten it that Los Supremos aren’t going to rule in Trump’s favor in an RTAA petition to decide the scope of the IEEPA.
