On the NewsMax program “American Agenda,” Touro College professor Thane Rosenbaum told the hosts that because the Chief Justice of the US Supreme Court isn’t going to preside on the Senate impeachment trial of Donald Trump, it “demonstrates yet again that we’re not prosecuting a sitting president.”

“If the Chief Justice of the Supreme Court is not sitting as the judge, that demonstrates yet again that we’re not prosecuting a sitting president; we’re prosecuting a private citizen,” Rosenbaum said.
“The jurors in this case are not unbiased,” Rosenbaum continued. “They are essentially the victims of this crime, so this is not as if this was a jury of his peers sitting impartially.”
Rosenbaum failed to recognize that everyone knows Trump isn’t the sitting president–well, at least 80% of the population realize that–nor does he seem to understand that the process isn’t a criminal prosecution, but a political process, therefore there is no demand that the Senators be impartial, just that they “will do impartial justice according to the Constitution and laws,” according to the oath they take.
