Pennsylvania GOP Senate Candidate Dave McCormick’s campaign sued to have undated mail-in ballots counted as he trails Mehmet Oz by less than a thousand votes in the too close to call primary election, the Washington Examiner reports. “Both the Pennsylvania Supreme Court and the US Court of Appeals for the 3rd Circuit have held that mail-in ballots should not be disqualified simply because the voters failed to hand write a date on the exterior mailing envelope of their ballots,” McCormick campaign lawyer Chuck Cooper said in a statement. “Because all ballots are time-stamped by the County Boards of Elections on receipt, a voter’s handwritten date is meaningless. All timely ballots of qualified Republican voters should be counted.” Note how he said “Republican voters” because in the 2020 election, when Trump was trying to get all mail-in ballots tossed in Pennsylvania, he would’ve been okay with them not counting the Democrat mail-in votes.
