A three-judge panel from the 9th Circuit Court of Appeals has ruled that California’s ban on large capacity magazines holding more than 10 rounds is an unconstitutional limit on Second Amendment rights, the Associated Press reports.
In an opinion written by Trump-appointed Judge Kenneth Lee, the panel determined that the ban fundamentally impacted an individual’s right to self-defense. GW Bush appointee Consuelo Callahan joined Lee in the majority, with Clinton appointee Barbara Lynn dissenting.
California Attorney General Xavier Becerra said his office will review the opinion and decide if they will appeal to a the court en banc.
Lee wrote that the law would make illegal some magazines that come standard with a variety of handguns, including Glocks and Berettas. He also repeated a common NRA talking point that individuals may find the need to have a large capacity magazine when they live in rural areas and police response is minutes away.
