The Texas Supreme Court on Sunday has rejected a motion by three republican candidates and a conservative activist to invalidate 127,000 ballots that were cast in Harris County through drive-thru voting, the Austin Stateman reports.
The same complaint will be heard by a federal judge on Monday, with Democratic Senate candidate MJ Hegar and other Democratic organizations requesting to join the defense.
The republicans suing to disenfranchise the voters are state Rep. Steve Toth who is running for re-election; Sharon Hemphill, a candidate for district judge in Harris County; congressional candidate Wendell Champion; and Republican activist Steven Hotze.
The republican claim that drive-thru voting is illegal because it was not specifically allowed by the Texas state legislature. The measure was implemented to held prevent the spread of the coronavirus.
