According to Fox “News,” outgoing President Donald Trump, the first incumbent to lose reelection in 28 years, “under some conditions … would consider an appropriate transfer of power.”
Under the Constitution, however, there are no conditions a losing incumbent can impose to vacant an office another candidate had won in an election. It’s unclear what conditions Trump would attempt to put in place to try to delay his ejection from office.
Trump has claimed that the votes against him in various states are illegal and fraudulent, while those in states that he thinks favor him must be counted. Numerous lawsuits the Trump campaign have filed to either stop counting or eliminate certain votes have failed.
