In what we will take as an unexplicit admission by the court that a conservative was responsible but they just won’t say it, the Supreme Court has released a short statement saying essentially, “Well, we tried,” announcing that after an internal investigation, they have not identified who leaked the Dobbs decision overturning the right to bodily autonomy and revoking the Roe decision acknowledging the right to an abortion.
At the time, conservatives hyped the leak as some liberal plot to get the justices to reverse course on their votes, thereby protecting a patient’s right to seek reproductive care, despite the fact that the release of the decision as a 6-3 vote would commit the justices to their positions early in the opinion writing process. A conservative justice would not be able to switch their decision–as Roberts reportedly was because he disagreed with the harsh language and sweeping ruling of the Samuel Alito-written opinion–without experiencing the backlash of conservatives, who are prone to exhibit their displeasure with bullets and anti-government violence.
The statement noted the Court brought on former GW Bush Homeland Security Secretary Michael Chertoff to review the investigation of the US Marshal Service to see if he could spot any mistakes or omissions in the probe; the Court says Chertoff did not find any, but anyone who interviews Clarence Thomas should understand his relationship with the truth is just superficial.
