The DC Circuit Court of Appeals on Tuesday handed Justice Department special counsel Jack Smith’s team a setback in their pursuit of Pennsylvania MAGA Congressman Scott Perry, whose phone was seized pursuant to a search warrant in August 2022 which Smith sought to access to see if the House Freedom Caucasians leader had any criminal liability in his involvement in the plot to overturn the Orange Warlord’s humiliating defeat in the 2020 election, Politico reports.
The ruling may not be the end of the road for Smith as he can still seek a review by the court’s full bench. Perry’s lawyers sued after the seizure, which came months before Smith’s appointment, seeking to hide behind the Speech and Debate clause to keep the phone’s contents out of the hands of prosecutors even as the phone itself is very much in a federal evidence locker.
