Arguing in a hearing in Philly DA Larry Krasner’s lawsuit against Elon Musk over his $1 million lottery scam in Pennsylvania, defense lawyer Chris Gober told the judge on Monday that the giveaway is not actually a lottery, instead claiming “There is no prize to be won” and winners “are not chosen at random” but by their personal story and “suitability to serve” since it’s actually a salary they “earn” to be a “spokesperson” for the America PAC’s pro-Trump efforts, CNN’s Marshall Cohen reports.
Kranser’s office responded by calling that a “complete admission of liability” and Musk is running an illegal lottery under Pennsylvanoa law, showing the judge a clip of him literally saying “we are going to be awarding $1 million randomly” when announcing the “salary.” Gober then tried to argue that “randomly” and “by chance” are interchangeable. So yeah, that’s how it’s going in court for Musk.
