The Indiana doctor, thrust into the national spotlight after she performed an abortion on a 10-year-old rape victim from Ohio who could not get one in her own state because of a newly-enacted abortion ban, is suing the Indiana Attorney General for harassment, Politico reports.
Indianapolis OB-GYN Caitlin Bernard said she and her colleague, Amy Caldwell, allege Republican Attorney General Todd Rokita is filing “frivolous” demands for medical records based on false reports made to prosecutors to harass abortion providers. Bernard and Caldwell claim demands made by Rokita are for confidential medical records and in some cases, for records of people who were never their patients, calling them “fishing expeditions.” In all cases, the doctors have jumped through legal hoops to protect their practices and patients.
“The Attorney General’s…improper conduct dissuades patients who need emergency abortions from seeking care. It also threatens patients seeking legal abortions that their most personal and private medical records and health care decisions could be exposed as part of a meritless investigation,” the lawsuit states.
