As expected, the US Supreme Court on Monday dropped a ruling declaring that an insurrectionist can run to lead the government he attempted to overthrow on January 6, 2021.
“A group of Colorado voters contends that Section 3 of the Fourteenth Amendment to the Constitution prohibits former President Donald J Trump, who seeks the Presidential nomination of the Republican Party in this year’s election, from becoming President again. The Colorado Supreme Court agreed with that contention. It ordered the Colorado secretary of state to exclude the former President from the Republican primary ballot in the State and to disregard any write-in votes that Colorado voters might cast for him. Former President Trump challenges that decision on several grounds. Because the Constitution makes Congress, rather than the States, responsible for enforcing Section 3 against federal officeholders and candidates, we reverse,” the court wrote in a 9-0 opinion on judgment, making the lib-owning extra sweet for the MAGA trolls.
It was a 5-4 majority however that ruled only a statue enacted by Congress could affirmatively block the Orange God Emperor or any other insurrectionist from running for or holding federal office, edging out a lone dissent from Amy Coney Barrett and another from the three liberals. The upshot is that Congress cannot block Trump from taking office during the Electoral College count on January 6, 2025, though that seems kind of outside the Supreme Court’s jurisdiction.
