Libertarian state senator candidate Susan Hogarth sued the North Carolina state election commission as well as her local board after she was threatened with a misdemeanor for posting a selfie of her holding her completed ballot on social media, the Washington Post reports.
After taking the photo of her holding her votes cast for two long-shot Libertarian candidates and no one else, Hogarth says the rule against ballot selfies violates her First Amendment rights of self embarrassment expression. Law enforcement officials say it’s a protection against people taking photos as proof of how they voted in a vote-buying scheme that sounds completely like an urban legend.
