UPDATE 12:27 p.m. ET: CNN reports that the two sides have agreed that the plea deal with cover the gun charges, outstanding tax nonpayment issues from 2014 to 2019, and drug charges. The two sides agreed that the plea deal does not cover other outstanding charges that may (or may not) be under investigation.
Original story: Major confusion going on in the Hunter Biden court hearing as the two sides cannot agree on the issues included in the plea agreement which governed a felony gun charge and two misdemeanor tax charges. According to MSNBC reporting, the prosecutors and Biden’s counsel had a disagreement on whether the agreement covered any potential future charges relating to his business dealings overseas.
When asked by U.S. District Court Judge Maryellen Noreika, a Trump appointee, if he would accept the plea agreement if it did not cover potential foreign agent registry charges or other charges that the government says are currently being investigated, Biden said he would not accept the agreement if other charges are still hanging over him.
The judge ordered a ten-minute recess around 11:30 a.m. to have the two sides hash out the information, but both sides have said that there is no plea agreement “at this time” that both sides agree to. Noreika wants to ensure that the defendant is clear on what is covered in the deal and what’s not. MSNBC analyst Barb McQuade gave the likelihood of the two sides working out the details of the plea deal Wednesday at “greater than 50%,” saying that the issues seem to be clarification and not significant matters of substance.
