Disgraced former President Trump waged a desperate, last-minute court battle earlier this month to prevent former Pence Chief of Staff Marc Short from testifying to the grand jury investigating the attempted coup following his humiliating loss to Joe Biden in the 2020 election, but failed as the DC Appeals court rejected his bitching and cleared Short for questioning, Politico reports.
The main focus of Politico’s article is a sealed ruling from DC Circuit Court Judge Beryl Howell that appears to be what precipitated the embarrassing defeat at the appeals level. Politico and the New York Times have filed a motion for Howell to unseal the ruling. A hearing is scheduled for November 15th. Just spitballing here, but it could be that Howell ruled there’s a crime-fraud exception to Donald’s assertions of executive privilege over aides’ testimony. Lawyers please comment below.
