Supreme Court Justice Sam Alito’s stay over the counting of undated mail-in ballots that could have made the outcome of the Pennsylvania Republican Senate primary much closer had it been lifted earlier – but still very unlikely to allow Dave McCormick to prevail over Mehmet Oz – was tossed on Thursday by a 6 – 3 majority. The original plaintiff David Ritter, the Republican candidate for a Lehigh County judgeship, sought to have 261 such ballots disqualified as his Dem opponent, Zachary Cohen led by only 74 votes in a race that was apparently still undecided since November 2021. The whole thing is confusing as hell, to be quite honest. It’s not clear why the case made it to the Supreme Court just as the GOP Senate primary was in a recount. All we can say for certain is that Alito, Thomas, and Gorsuch wanted this stay to remain in place and the other six did not.
