In a motion filed publicly explaining another motion filed under seal in the Washington, DC case against disgraced former President Trump over his post-2020 election coup attempt, Justice Department special counsel Jack Smith on Tuesday informed circuit Judge Tanya Chutkan that “the pressing matters before the Court – including the defendant’s daily extrajudicial statements that threaten to prejudice the jury pool in this case, as described” in the accompanying sealed motion.
Now we’d like to be cautious about the implications of this since the entire motion is pretty deep in the weeds but it would seem as though Smith is publicly saying that Trump’s “daily extrajudicial statements” are directly referencing some evidence against him provided in discovery in a direct violation of the protective order. The sealed motion does not appear to center on the statements entirely, but rather a sideswipe in an otherwise routine filing, much like how Smith nonchalantly included that “IF YOU GO AFTER ME, I’M COMING AFTER YOU!” meltdown in their proposal for the protective order early last month. Maybe a “just for the record” kind of thing to remind Inmate P01135809 that they’re watching him and he who sows the fuck shall reap the find out.
