Two former Loveland, Colorado police officers will face criminal charges for an assault on a 74-year-old woman with dementia who walked out of a store carrying $14 in merchandise, CBS News reports. The incident left the woman with a broken arm.
Austin Hopp has been charged with using excessive force, including second-degree assault, attempting to influence a public servant and official misconduct for the incident that occurred in June 2020. Daria Jalali faces charges of failing to report use of force, failing to intervene and official misconduct.
According to Hopp’s body cam footage, Hopp responded to a call from the store that the woman had walked out of the store without paying for the merchandise. Hopp approached 74-year-old Karen Garner in a field as she walked away from the store. Hopp attempted to talk to Garner, who appeared confused and unable to understand what the officer was saying. Hopp then grabbed the arm of the 80-pound woman and pushed her to the ground, breaking her arm and dislocating her shoulder.
Jalali arrived on the scene after Hopp had handcuffed Garner, who laid on the ground. Hopp and Jalali stood over Garner, laughing and joking, before loading her into a squad car. A third officer was filmed on police station camera footage laughing and joking about the incident. Garner did not receive medical attention for six hours after her arrest.
“You can see in the video how they’re laughing at my mom,” Garner’s daughter, Allisa Swartz, said at a news conference. “I feel like they think that they are above the law, and they are the ones who are supposed to be protecting all of us. I just want justice for my mom.”
All three officers resigned from the force after an attorney for Garner’s family released the body cam footage, raising public outrage and prompting a federal use-of-force investigation.
