DC Circuit Judge Tanya Chutkan on Monday dismissed the post-2020 election coup attempt case against convicted felon President-Elect Trump without prejudice, meaning that the prosecution can be revived. Whether an appellate court could override the prejudice aspect of the dismissal or if the statute of limitations can be tolled until 2029, we don’t know. That Chutkan granted Justice Department special counsel Jack Smith’s prejudice-free request would seem to indicate that the door would still be open to hauling a nearly 83 year-old bloated orange dementia patient into court.
