After the Department of Justice attempted to withdraw the charges against Flynn following his guilty pleas, the DC Circuit Court of Appeals Monday found that the presiding judge in the case, Emmet Sullivan, had the ability to hear arguments and call witnesses to testify about whether the DoJ could properly drop the prosecution.
