The Citizens for Responsibility and Ethics in Washington (CREW), a 20-year-old non-partisan watchdog group that monitors questionable behavior by elected officials in DC, has filed a lawsuit in Colorado seeking to prevent Donald Trump from the ballot in November 2024 based on Section 3 of the 14th Amendment, ABC News reports. It’s the first significant lawsuit to remove Trump from a state ballot.
The clause, known as the Disqualification Clause, prevents people who had previously taken an oath as a public servent to protect and defend the Constitution from holding future office if they subsequently “engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.” Proponents of the lawsuit say Trump’s support for the January 6th domestic terrorist attack on Congress meet the criteria outlined in the Constitution for exclusion from public office.
